High Court is provoking: Suranjit

The High Court's judgement on the ruling of the Speaker was 'provocative and conspiratorial', Minister Without Portfolio Suranjit Sengupta said on Tuesday.

His remarks came during an unscheduled discussion on the first day of its 14th session of Parliament.

Suranjit said, "Parliament won't exist if the Speaker's ruling is not enforced, nor does this judiciary or these judges. Issuing a verdict against his [Speaker] ruling is not only provocative, but also conspiratorial."

Speaker Abdul Hamid issued a ruling in May saying High Court judge Justice AHM Shamsuddin Choudhury violated the Constitution by making 'derogatory comment' about Parliament.

Following the observation, the bench of Justices Hasan Foez Siddique and ABM Altaf Hossain on July 24 declared the Speaker's June 18 ruling was 'non-existent in the eye of law' and 'has no legal basis after a petition sought the court's intervention over the Speaker's ruling that Justice Choudhury violated the Constitution's Article 78 (1).

Speaker Hamid pointed out on Tuesday, "The judiciary is certainly independent, but Parliament is sovereign."

He said that the Constitution was the highest law of the country and Parliament was its custodian. Addressing the MPs, Hamid said, "Let there be no doubt, let no one say this is a subjudice matter. We can most certainly discuss it here."

Suranjit later dubbed the court's verdict ad 'irresponsible'. "There is no martial law in which justices did not collude."

Earlier, Awami League lawmakers Tofail Ahmed and Sheikh Fazlul Karim Selim, speaking on a point of order after the question-answer session, set the House on fire.

Parliament became heated with the MPs demanding revival of Bangladesh's original constitution of 1972, which allowed Parliament to impeach judges.

A former Commerce Minister and a long time party stalwart, Tofail also questioned the qualifications of the judges of the bench.

He said, "Now the High Court judges are appointed on political grounds, and I don't think Justice Altaf Hossain has even completed the mandatory 10-year attachment with the High Court before being appointed to the bench."

"I strongly believe this verdict was not decided in the courtroom," Tofail added.

He said the Ministry of Law, Justice and Parliamentary Affairs should keep an eye on these appointments.

Tofail ended with a proposal to revive Bangladesh's original constitution of 1972, which allowed Parliament to impeach judges.

Jatiya Samajtantrik Dal MP Mainuddin Khan Badal said the court's observation was 'obsolete, obscene and obnoxious'. "This is a rather ominous sign," he added.

Sheikh Fazlul Karim Selim also spoke on the same issue before Tofail. "The justices have given a bizarre, eerie verdict. The justices have stepped beyond their line."

"An independent judiciary does not mean anyone can say anything according to their own wishes. Justices are not beyond law. The judiciary is independent, but not sovereign."

He also demanded formation of Supreme Judicial Council to 'impeach' the Supreme Court judges.

Addressing the Speaker, Tofail raised questions over the identity and qualification of Deputy Attorney General Biswajit Roy who argued at the hearing against the Speaker.

He also questioned Justice ABM Altaf Hossain's qualifications for being a judge.

The senior ruling Awami League MP claimed recently appointed Justice Zafar Ahmed, nephew of Justice AHM Shamsuddin Choudhury, did not complete the mandatory 10-year attachment with the High Court as an advocate.

Justice Zafar Ahmed was enlisted as a lawyer in High Court Division in 1995.

Awami League MPs Sayedul Haque, Sheikh Fazle Noor Tapash, Fazle Rabbi Mia, Worker's Party's Rashed Khan Menon, JaSaD MP Hasanul Haque Inu and Jatiya Party MP Mujibul Haque Chunnu also harshly criticised the judges.

Menon said, "The two judges have violated the Constitution's Article 78. A Supreme Judicial Council can be formed against them and a motion condemning it can be adopted in Parliament."

However, Tapash told Parliament, "A vested quarter wants to lead Parliament and the judiciary to confrontation. We cannot fall for this trap. The court has given its observation over the Speaker's ruling. It cannot be called a verdict."

"This is an observation, there is no legal binding," he pointed out.

At this point, Speaker Abdul Hamid told him the court gave its verdict, not just observation.

"As the Speaker of this Parliament, I would like to say that this is not a case over land dispute or murder charges. This is a discussion about the Constitution. It cannot be sub-judice."

He said he would comment further on the issue later.

'comeback' trail

Emboldened by a clean chit in the cash scam, former railway minister Suranjit Sengupta said on Wednesday he is 'returning to politics'.

Days after the scandal involving his personal aide surfaced, he stepped aside saying it was taking 'a break of journey'.

Speaking at a press conference at his Jigatola residence, Suranjit, now a minister without portfolio, said: "I am innocent. It is now clear through an independent and proper investigation.

"I will return to politics, will take the responsibility of serving the people."

When asked whether he was going to take back the post of the minister he lost because of the cash scam, he said the prime minister will decide that.

"This is an issue of the government," he said.

It was his third news conference after his Assistant Personal Secretary (APS) Omar Faruq Talukder was detained by the border guards on Apr 10 with Tk 7 million in cash in the car carrying Faruq and two top railway officials.

He announced his resignation at a media call at the Rail Bhaban on Apr 16, taking 'full responsibility' for the cash scandal. He said he would return once he was cleared by investigation.

A day later, a government press note said Suranjit was made a minister without portfolio.

The Railway Ministry in a report to the Secretary on May 13 said no evidence that suggested Suranjit was involved in the cash scandal was found.

Suranjit resigns taking blame

Taking 'full responsibility' for the recent cash scandal involving one of his personal aides, railway minister Suranjit Sengupta stood down on Monday.

Suranjit, who took over the newly-craved ministry barely five months back, made the announcement at a press briefing at the capital's Rail Bhaban after days of drama and suspense.

He met prime minister Sheikh Hasina at her official residence Ganabhaban Sunday night, first time since the scandal surfaced.

"Even though I was not linked to the incident, I am resigning to strengthen democracy," he told the press conference.

The resignation letter will be sent to the prime minister later, the ruling Awami League's advisory council member told reporters.

He came under pressure after his assistant personal secretary (APS) Omar Faruq Talukder was detained by the Border Guard Bangladesh personnel in the early hours of Apr 10 with unaccounted-for Tk 7 million in the car carrying Faruq and two top railway officials.

The officials are Railway Division (east zone) Yusuf Ali Mridha and Government Railway Police (GRP) (Dhaka zone) commandant Enamul Haque.

Mridha and Enamul were temporarily suspended and Faruq was fired on Sunday.

The ministry has asked the Bangladesh Bank to freeze Faruq and his wife Marzia Farhana's bank accounts and to investigate their banking transactions.

Opposition BNP has been claiming that the minister is also linked to the scandal and called for his resignation. But, Suranjit had rejected the demand saying, "The opposition hasn't given me the post ... I won't leave the post on their demand."

But after he met party president Hasina on Sunday night at Ganabhaban, rumours were rife that he was going to step down. The gossips grew when he was absent in the regular Cabinet meeting on Monday morning.

Though his briefing was supposed to begin at 12pm, Suranjit arrived at Rail Bhaban after 12:30pm and came to the conference room a 1:45pm with railway director general Abu Taher and railway secretary Fazle Kabir after spending some time at his chamber.

"I won't say much today. I won't take any questions and won't answer any either," he said at the beginning of the 20-minute briefing.

He said, "The incident is fully my responsibility, it is neither my party's nor the government's. I met the prime minister last Sunday for about an hour after she returned home. I expressed my desire to her to resign and she agreed."

Explaining the situation, he said, "A new debate has risen over the incident of Apr 10. People are saying many things. As my APS and two railway officials were linked to the incident, this is a responsibility of my ministry."

A very depressed Suranjit, who has been in politics for over 50 years, told the media call, "Everyone has been benefitted in many ways in 40 years of independence of Bangladesh. But I'm feeling sad to say this that no one made sacrifices in those years."

"I'm facing a difficult test at the end of my life," he added.

Protesting his innocence, he said, "Most of the people barring some intellectuals and a couple of people in my party have asked me whether the investigation would be free of influence if I am in office. I have to take responsibility for this incident to strengthen democracy. Though I'm not linked, I've decided to resign."

However, he put this resignation 'just a break' in his journey in Bangladesh's politics.

"I'll prove my innocence and will be back in politics in a transparent manner," Suranjit said.

After the press briefing, Suranjit held his last meeting with top railway officials at Rail Bhaban's conference room on the sixth floor. He urged the officials to keep up the good work achieved in the last several months.

Suranjit then left the Rail Bhaban around 3pm in a black jeep.

Suranjit, who has been MP in most parliaments formed since independence, took oath as the railway minister on Nov 28 last year. This is the first time Suranjit became a minister. During Awami League's last tenure, he was Hasina's parliament affairs advisor.

He joined Awami League in the early 1990s. He was a member of the country's first committee to constitute the charter and co-chairman of the special committee on the 15th Amendment to the Constitution.

Suranjit was also the head of the parliamentary standing committee on the law, justice and parliamentary affairs ministry until recently.

Suranjit suspends 'cash carrying' aide

Railway minister Suranjit Sengupta suspended his assistant personal secretary on Wednesday, a day after he was found moving in a car with unaccounted for Tk 7mn in cash.

Minister's personal secretary Akhtaruzzaman confirmed that a suspension order has already been issued to APS Omar Faruq.

Faruq has been put under suspension with effect from Wednesday morning.

Soon after recovery of money, the minister had blamed the driver for the whole incident. He had said that the driver tried to 'blackmail and hijack' Faruq while returning home with the cash.

Border Guards Bangladesh had found the money in the car carrying Faruq and general manager of Railway Division (East) Yusuf Ali Mridha at Zigatola in the wee hours of Tuesday. The only other person in the car was the driver.

However, they were released later and the law-enforcers remained tight-lipped on the incident.

Since the recovery, the minister, who took over the newly-created railways ministry barely five months back, has faced widespread criticism.

Newspapers reported that the money was taken as bribe for making appointment in the ministry.
